Former Anthrax Guitarist Dan Spitz Arrested on Domestic Violence Charge; Wife Calls Confrontation a “Big Misunderstanding”

Former Anthrax guitarist Dan Spitz , who played with the group from 1983 to 1995 and again from 2005 to 2007, was arrested in the early hours of Christmas morning at his home in Florida on suspicion of domestic violence, according to Palm Beach County records.

GossipExtra.com , a Florida-centric news blog, says it has obtained a police report which states that Spitz and his wife Candi “drank heavily” on Christmas Eve, and then got into an altercation during which a “verbal fight eventually became physical.” Palm Beach County Sheriff deputies allege Spitz tried to choke Candi, which left bruises around her neck. Spitz claims that his wife attacked him first, telling the deputies she caused a number of scratches on his chest, neck and arms.

The website reports that Candi's mother, who was staying at the house and dialed 911, told deputies the guitarist was acting "very aggressive" towards Candi, and claims to have overheard her daughter scream, "I can't breathe" as the pair allegedly fought in their bedroom. The website also quotes the police report as stating that the confrontation was allegedly about a man Candi dated during the couple’s brief separation last year.

Despite what’s listed in the police report, Candi says the drunken altercation wasn’t as bad as it appeared to be, and she doesn’t plan on pressing charges against Spitz. “I’m not planning on pursuing this in court,” she tells the blog. “This was a big misunderstanding. My mom should’ve never called 911.”

Candi adds that Spitz didn’t harm her at all, noting that she is fully capable of defending herself. “He never hit me or tried to harm me,” she explains. “He did shove me, and unfortunately I bruised my shoulder. But come on: He’s 5 feet tall and 100 pounds all wet. And I kickbox. He could never harm me if he tried.”

Spitz was released from custody on his own recognizance on Thursday afternoon, according to Palm Beach County records.
