A-G files Motion to Stay Dane County judge order in Appeals Court

MADISON, WI (WSAU) - The new law that stripped many of the bargaining tools used by unions is going back to court, as expected. Attorney General J.B. Van Hollen has filed a Motion to Stay the decision made recently by Dane County Judge Juan Colas on the Act 10 constitutionality issues.Colas struck down parts of the new law saying they were unconstitutional. Van Hollen disagrees, and believes Judge Colas’ order won’t stand.

The Attorney General says his office went to great lengths while the Act 10 legislation was drafted to ensure it was written properly and could withstand court challenges.

The motion was filed in the 4th District Court of Appeals Thursday afternoon. It’s unknown when the court may consider the motion. Van Hollen is pushing for the stay to prevent unions and employers from making new contracts during the time the issue is tied up in court.
