APPLETON, Wis. (WTAQ) - The Outagamie County DA's office will not file charges against 2 Appleton police officers in a fatal shooting this week. 

District Attorney Carrie Schneider at a press conference Friday says the officers were justified in their use of force in the shooting death of 35-year-old Armando Aponte Wednesday. 

During a response to a call for a domestic disturbance to 11 Hollyhock Court, Schneider confirmed Aponte charged at Lt. Carlos del Plaine and Officer Joseph Lidbury with two swords. 

A woman and four children did escape through the front door, but a one-and-a-half-year-old girl remained inside the home, along with Aponte.

An autopsy showed Aponte had a blood-alcohol content of 0.35.

Green Bay Police investigated the shooting, which is a common procedure when an officer is involved in a shooting. It's the first use of lethal force by Appleton officers in 24 years.
